Locklear, Wagner fight could bring charges

To say Heather Locklear has had a rough start to 2012 would be something of an understatement.

Though the O.G. "Melrose Place" actress was finally released from the hospital last week, she's once again down on her luck, as it emerged today that she and her ex-fiance Jack Wagner could face misdemeanor battery charges over a physical altercation that went down between them late last month.

Los Angeles City Attorney spokesman Frank Mateljan confirmed that the former duo was due to attend a hearing at an unspecified (though soon) date to determine what, if any, charges will be filed. One, both or neither could wind up facing misdemeanor battery charges.

Though the spokesman was quick to point out that as it stands now, both actors' records are clean. Well, at least in terms of this particular incident.

"No criminal charges have been filed relating to this matter," Mateljan told E! News. "A City Attorney Office hearing for the two individuals involved will be scheduled in the next couple of weeks. No further action is scheduled after that."

As for the actual hearing date, that has yet to be set.

The incident took place in late December at Wagner's home. According to reports, an argument between the duo turned physical and cops were called to the scene. At the time, neither opted to press charges against the other, but the case was nevertheless forwarded to the City Attorney for review.

Hmmm ... maybe February will be Locklear's month?

An Initial Party Offering? China's communists go for an IPO of their news site.

China's Communist Party plans to sell stocks in the online version of its official mouthpiece the People?s Daily to raise money.

The ruling Chinese Communist party is using a classic capitalist scheme to raise money: An IPO.

Not that the party (slogan: ?Serve the People?) is offering the public shares in itself. But it plans to sell stocks in the online version of its official mouthpiece the People?s Daily.

The website?is having a hard time keeping up with the commercial competition, according to its owner People?s Daily Online Co. Ltd. in a preliminary prospectus filed with the China Securities Regulatory Commission. It gets one tenth the visitors than the most popular Chinese Web portal Sina.com, for example.?

To rectify this, the company wants to raise $83.5 million through an IPO in Shanghai to ?strengthen our marketing and expand our services and products,? the prospectus says. That way it hopes to catch up with Sina, which has tapped international capital markets by listing on the NASDAQ.

The company makes no reference to the fact that the party-owned website may owe its low profile to the stultifying nature of its content. Indeed, it mentions the ?People?s Daily journalism tradition? as one of its competitive advantages, which sounds a little dubious.

Another?selling point?it boasts, though,?is the ?preferential policy? the website enjoys; this means that the party which owns it also owns the government that makes the rules deciding who else is allowed to disseminate online news in China. Now that is a competitive advantage.?

Jon Huntsman Quits Presidential Race, Endorses Mitt Romney


And then there were five. Jon Huntsman has become the latest casualty of the race for the Republican presidential nomination, dropping out this morning after a decent, but not overwhelming showing in the New Hampshire primary last week.

In announcing his withdrawal today, he derided the negativity permeating the GOP primary race and immediately threw his support behind Mitt Romney.

"Today, I am suspending my campaign for the presidency," the ex-Utah governor and U.S. ambassador to China said at a news conference in Myrtle Beach, S.C.

"I believe it is now time for our party to unite around a candidate best equipped to defeat Barack Obama. Despite our differences and the space between us on some of the issues, I believe that candidate is Governor Mitt Romney."

Huntsman's support for the one-time Massachusetts governor is not unexpected given Romney's frontrunner status (he won both Iowa and New Hampshire).

There are also issues on which the two men agree, and both are open about their strong Mormon faith, though relations between the two have been frosty of late.

Huntsman, who was polling behind Stephen Colbert in South Carolina, had no path forward and exited not by criticizing Romney, but the "toxic" tone of the race.

"This race has degenerated into an onslaught of negative and personal attacks not worthy of the American people and not worthy of this critical time," Huntsman said.

Sprint remains tepid on Windows Phone at CES, confirms no new WiMAX phones are planned

This may have been a fairly big CES for Windows Phone, but it looks like Microsoft still has a fair bit of convincing to do in order to bring all the carriers fully on board. That includes Sprint, which does currently have a Windows Phone in its lineup (and is apparently considering more in the "August-September time period"), but remains decidedly unenthusiastic about the platform as a whole. As PCMag reports, Sprint's David Owens said that the carrier is willing to train its reps on Windows Phone, but that Microsoft has to "build the enthusiasm for the product," adding that the "number-one reason the product was returned was the user experience." Sprint's director of product development, Lois Fagan, further added that the carrier remains "cautiously optimistic," but that Windows Phone "just hasn't taken off." In other news, Owens also confirmed that Sprint would expectedly now be focusing all of its intention on its new LTE network, and not produce any more WiMAX-based phones -- although, as it's noted previously Sprint will continue to support the network itself through 2015.

The year's most anticipated new arrival is finally here: Beyoncé Knowles and Jay-Z (nee Shawn Carter) welcomed Blue Ivy Carter, a healthy baby girl, into the world on Saturday (January 7) in New York at Lenox Hill Hospital, according to E! News.

Beyoncé surprised and delighted fans around the world back in August when she not-so-subtly announced her pregnancy on our very own VMA stage.

Rumors have been swirling about the sex of the new bundle of joy since Beyoncé's close friend and former Destiny's Child member Kelly Rowland let it slip that "it" might be a "she."

"I have no idea what I'm going to buy Beyoncé at the baby shower because Jay is going to buy that little girl every single thing possible," she told told U.K. news agency Bang Showbiz. "She won't be spoiled, but she will be very well looked-after."

Fans are just as excited for Jay and B's bundle of joy. MTV News spoke to some of them recently, and many said that they expect the newborn to jump right to the top of the celebrity baby power list.

"A power baby, obviously," one fan said of the youngster's assumed superstar status, while another added, "It's gonna be a pretty cool baby, that's for sure. Probably gonna run New York City by the time he's 13 or 14."

Jason Derulo Fractures Neck, Cancels Tour

Jason Derulo was forced to cancel his upcoming tour on Thursday after fracturing his neck during rehearsals. According to the singer, he was trying to pull off an acrobatic move when he missed the landing and fell on his neck, causing an acute fracture of his vertebra.

Derulo, 22, addressed his fans about the accident on Twitter, posting a picture showing him in a neck brace and hospital gown and explaining, "I fractured my neck doing tumbling & acrobatics 4 tour! Always tryin 2 push boundaries 4 YOU! Like my new chain? ;)."

The singer's label also issued a statement from Derulo about the incident, which read, "To all my fans who planned to come to the 'Future History' world tour, the pain of letting you down cuts me way deeper than this injury I've sustained. My fans mean everything to me, so I'm praying for a speedy recovery in order to perform for you in the near future."

According to The Hollywood Reporter, as Derulo was being rushed to Memorial West Hospital in Pembroke Pines, Florida, he was told by doctors that he narrowly avoided being paralyzed in the incident. He's since been released from the hospital, but has been ordered to wear the neck brace for several months.

The tour, named after his second album
, which was released in September, was slated to kick off in Glasgow on February 23.

The singer recently rocked the stage for MTV's "NYE in NYC 2012" celebration when he performed a high-energy set
 of his hits "It Girl" and "Don't Wanna Go Home."

Tucson mass shooting survivors try to move forward

(AP) ? Ron Barber's nightmares wake him in the dead of night and he can still see it: The flash of a gun muzzle aimed at Rep. Gabrielle Giffords' head.

"Pop, pop, pop, pop, pop," went the gunman's weapon, recalls Barber, who fell to the ground, shot in the cheek and thigh.

He saw the pool of blood around his body and Giffords breathing shallowly as she lay facing away from him. Then he looked into the eyes of colleague Gabe Zimmerman and knew the 30-year-old was dead.

The shooter had moved methodically down a line of people, killing six people and wounding 13 before two men tackled him. The cold, bloody morning was one year ago on Jan. 8, a day that shattered many lives, shook the nation and changed the city of Tucson forever.

But to the bewilderment of those were weren't personally affected by the tragedy, Barber and some of the others who were there that day either don't feel any anger about the shooting or choose not to dwell on it. Instead, they're trying their best to move forward. They've bonded with each other in a way that only they fully understand, lobbied for legislation in hopes of preventing similar shootings and many of them have started nonprofits to bring some good from the tragedy.

Barber started the Fund for Civility, Respect and Understanding, which targets bullying in schools and spreads awareness about mental illness in hopes of preventing a similar crime. Accused shooter Jared Lee Loughner, 23, has bipolar disorder and showed signs of being disturbed for at least two years before the shooting.

Barber was diagnosed with post-traumatic stress disorder and has spent much of the past year trying to move forward from the shooting with his nonprofit and by undergoing extensive physical and emotional therapy. He also returned to work but only for half-days because of fatigue.

He still walks with a cane and has been experiencing more flashbacks and nightmares. In some of them, he imagines different scenarios that could have played out, including if he had been able to trip the gunman or grab the weapon.

"But I've learned from counseling that you can manage how you respond to these dreams, flashbacks," Barber said. "I don't think you ever completely forget, but you can manage it."

Pam Simon, another Giffords' staffer who survived two gunshot wounds to her chest and wrist, said the emotional journey is taking longer than she imagined. She has a fuzzier memory from that morning; some parts are dream-like, others crystal clear.

What stands out to her is the kindness of a stranger named Bob Pagano, who ran from inside the grocery store toward the gunshots that day and saw Simon face-down holding her chest.

Pagano put his sweater under Simon's head and told her, "I'm not a medical person but I will stay with you. You won't be alone."

And Pagano did just that, trying to comfort her by telling her that Giffords was still alive and that the gunman had been disarmed. He rode in the ambulance to the hospital with her and explained to her husband what had happened.

"I look back on it and if I had no one giving me input, how much more terrifying that situation would be," Simon said. "I think it actually says a beautiful thing about society, that even in that horrifying moment, regular citizens scrambled to help."

Simon also is back at work, though part-time, and struggles most with Zimmerman's death. One moment, Simon will be OK and then stumble across a reminder of Zimmerman and become overwhelmed with emotion, she said.

"The thing that I learned about grief is that it's a slow and very jagged process," she said. "You have to stop and pause and reflect, and what I've learned is that it's OK, that's part of the process, accepting and being open to those emotions."

She said she knows there's no quick fix but she's found something positive to focus on. Simon visits high schools and talks to students about how she has forgiven Loughner.

"It was kind of surprising to me that kids found it just strange that you could forgive someone who shot you, and I wanted to talk to them about how powerful that experience is, to not carry anger and that baggage around with you," she said.

Simon said she was still in the hospital when she decided to forgive. All she now feels for Loughner is "profound sadness" that he didn't get treatment for bipolar disorder before it was too late.

"It's absolutely pointless to weigh myself down with anger or hatred toward this young man," she said.

Suzi Hileman has chosen to move past the anger.

She took her young friend and neighbor, 9-year-old Christina-Taylor Green, to meet Giffords that day so the bright young girl, who was interested in politics, could meet a real-life female politician.

Hileman said that Christina planned to ask Giffords about pollution and the Deepwater Horizon oil spill in the Gulf, and what the country could do about them. The girl, wearing sparkly tennis shoes, blue sapphire earrings, and skinny jeans, began "jumping up and down" when she spotted a photographer at Giffords' event that day, overcome with excitement about getting their picture taken with the congresswoman, Hileman said.

"And then boom. The next thing I remember is looking down at my leg and seeing blood pouring out of a hole in my jeans," Hileman said. "And then I remember lying on the ground holding hands with Christina telling her not to die and leave me there.

"'We came together, we're going to leave together, Sweetie,'" Hileman told a dying Christina. "'I love you. Don't leave me on the cold ground by myself.'"

Hileman had tried to shield Christina when the bullets began flying, but the girl was fatally hit once in the chest. Hileman was shot three times.

When Hileman was taken off a ventilator in the hospital for the first time, the first words out of her mouth were, "What about Christina?" Even after learning the truth about the girl's death, a heavily medicated Hileman would cry out for the little girl.

"Someone took a gun, aimed it at a 9-year-old and killed her, and I was responsible for bringing her home and I couldn't do that," Hileman said. "That pisses me off. It's infuriating, but being angry doesn't get me anywhere. The shooter does not get to win.

"I couldn't protect Christina, I couldn't save myself, but there are things that I do have control over and I can find joy in really simple things and tremendous things."

Hileman has found a way to move forward with the help of family and friends, and by starting a nonprofit called GRandparentsINresidence, or GRIN, in which she pairs up volunteers with projects at schools.

She came up with the idea as she learned to accept generosity from people who wanted to help her following the shooting ? people who brought her and her husband food for three months straight, delivered her books and music, and cheered her on when they saw her around town using a walker.

"I saw first-hand that it is better to give than to receive," Hileman said. "It helps me heal and it takes me out of myself, and sometimes myself is not a happy place. It's easy to go down the dark path."

Mavy Stoddard knows about the dark path. She was ninth in line to see Giffords that day with her husband and "soul mate," Dory.

The two were grade-school sweethearts who married when they were 60 years old after each of their spouses died; they spent the next 15 years traveling the world and building a home together in Tucson.

Once the shots broke out, Dory pushed Mavy to the ground and shielded her body with his own.

"From there it was a volley of bullets and I had no idea what was going on, but I felt him when he was shot and I knew it was a head wound," she said. "What I remember telling him was, 'Breathe deeply, Honey. They're coming,' and I said, 'I love you' and he died right there in my arms."

In her dark moments, Stoddard thinks of how much easier it would have been if she had died with Dory that day.

She gets through them by talking to Dory's photos on the wall and to his beloved dog, Tux. She also stays busy by volunteering at a church and with a group that gives new clothes to low-income children, teaching Bible class and lobbying Congress with other shooting survivors to pass legislation that would toughen background checks on those looking to buy guns in hopes of weeding out felons, people with mental illness and drug users.

She also has decided not to be angry.

"I miss my best friend. It's a terrific loss but I can't bring him back," Stoddard said. "I can't hate anybody and I can't blame anybody and I can't be angry with anybody. Who am I going to be angry at? God? No. The shooter? Why?"

She found the holidays to be particularly difficult but got through them by doing what Dory would have wanted her to do: putting up holiday decorations and going to the same Christmas and New Year's parties that she and Dory went to every year with the same group of eight longtime friends.

"You don't have much of a choice. You either sit down and do nothing, which is usually miserable, or you get up and build a life," she said. "And that's what I'm doing, that's what Dory would expect of me."

Roxanna Green found therapy in writing a book about her daughter Christina, "As Good as She Remembered," in which she talks about the girl's spirited life, the shock of her death and her family's struggle without her.

She and her husband John also started the Christina-Taylor Green Memorial Foundation, which gives financial help to low-income students and schools, to honor their daughter's legacy.

One thing that all the survivors have found comfort in is each other.

On a Thursday afternoon in Tucson just before Christmas, three of them gathered in Stoddard's cozy home filled with memories from her life with Dory.

Hileman brought brownies for Stoddard and Pat Maisch, who grabbed a gun magazine from Loughner after two men tackled him to the ground during the shooting.

The three women seem more like family than people who were complete strangers just one year ago. They hug long and tightly, they tell each other "I love you," and they get each other through some of the toughest moments in their lives.

Hileman was still in a wheelchair from her wounds when she went to one of Loughner's court hearings, the first time she would see him since she was shot.

At first, she wasn't sure she could do it. She sat outside the courtroom, racked with sobs when Stoddard saw her.

"I told her, 'We're not going to let him win,'" Stoddard said. "Then she sat up straight, stopped crying, and we went in."

Once inside, Hileman remembers shaking and Stoddard grabbing her hand.

"She told me Jesus and Dory and Christina were watching me and we would get through it together," she said. "And we have gotten through it together."

US envoy visits China after Kim Jong Il's death (AP)

BEIJING ? Senior U.S. and Chinese diplomats on Wednesday discussed North Korea following leader Kim Jong Il's death and whether that will delay resuming talks on the country's nuclear disarmament and deliveries of U.S. food aid.

Assistant Secretary of State Kurt Campbell is the highest level U.S. official to visit the region since Kim's unexpected death two weeks ago raised new concerns about poor, nuclear-equipped North Korea's stability and disrupted U.S.-North Korean talks just as they were making headway.

Campbell met Wednesday with Chinese Vice Foreign Minister Cui Tiankai and was due to meet with other senior officials and Chinese scholars before flying to South Korea later in the day.

Also on the agenda in Beijing were discussions about the Obama administration's tentatively warming relations with Myanmar, which has relied heavily on Chinese trade, investment and diplomatic support.

Like Myanmar, North Korea has become dependent in recent years on Chinese diplomatic protection and economic largesse. Following Kim's death and with a transition to his son Kim Jong Un under way, senior Chinese officials have urged Washington not to take any actions that might provoke Pyongyang or destabilize the impoverished country ? a message diplomats said was likely to be repeated in Campbell's meetings.

In the past two years, tensions spiraled in the region as North Korea conducted a nuclear test and shelled a South Korean island among other provocations. In recent months, Washington and Pyongyang have held quiet negotiations and were nearing agreements on resuming U.S. food aid when Kim died.

That agreement was seen as a first step toward restarting the stalled disarmament talks, which also include China, Japan, South Korea and Russia. Pyongyang has cast doubt over whether those negotiations may be quickly restored. Its powerful National Defense Commission released a hardline statement over the weekend saying North Korea would never deal with South Korean President Lee Myung-bak

Sony?s Poorly Received Online Pass System Spreads to PlayStation Vita

Sony initiated a new method to combat the sale of used games this year by implementing ?Online Pass? for its first and second-party games. It started off with Resistance 3 and continued in Uncharted 3: Drake?s Deception, leaving second-hand buyers unhappy. Sony stated that the online pass is here to stay. With the recent release of a new Sony handheld, PS Vita, many didn?t think that the concept could possibly make the jump. However, if the release of Hot Shot Golf Vita is to set the precedence for the future, online pass is indeed coming to PS Vita titles.

Destructoid posted their discovery of an online pass code inside of a Hot Shots Golf Vita case. They also posted a screenshot of the PSN store selling the online pass code (priced at 900 yen in Japan). The good news is that similarly to a digital version of games sold on the PSN store, it will also include the online pass.

Choosing is hard. And in the case of ASUS' forthcoming netbook line, totally not necessary. Just days after Intel snuck out details surrounding the next generation of its Atom line, out flows shots and information about what'll undoubtedly be one of the first next-gen netbooks to use 'em. The Eee PC Flare line is expected to supplant the long-standing Seashell range at this year's Consumer Electronics Show, with a smattering of models to be lining ASUS' booth. Outside of lively, sleeker exteriors, we're told to expect models with the new N2600 and N2800 Atom CPU line, a 12-incher powered by AMD's Fusion APU line and the token chiclet-style keyboard that we've all grown used to. It's also possible that we'll see revised 10-inchers alongside the big boys, with the 1225B, 1225C, 1025C and 1025CE named in particular. Naturally, we'll be bringing you more as we get it. Oh, and "netbooks are back, baby!"

Jobs Program for Older Americans Struggles

With passage of the 2012 budget Congress failed to restore any of the deep cuts made last year to the largest federally funded program that employs older adults. Last year's cuts have already taken a heavy toll.

At a time when workers between 55 and 74 with limited education and jobs skills are far more likely to lose a job and stay out of work longer, Congress held steady on the funding level for the Senior Community Service Employment Program (SCSEP) at last year's amount -- cut 45 percent from two years ago.

The impact on SCSEP's ability to counsel and provide subsidized jobs for older adults has been "devastating," according to Tony Sarmiento, executive director of Senior Service America, Inc. in Silver Spring, Md. The good news is Congress didn't impose any additional cuts.

Sarmiento compared the third quarter of 2011 to the same period in 2010, prior to the budget cuts. For the entire country, jobless older workers joining the SCSEP program dropped from over 13,000 in that quarter of 2010, to 1,900 in the same period of 2011, an 85 percent loss, Sarmiento said.

In 15 states, he noted, the reduction in SCSEP participants was 95 percent. Five states had no new participants, including Maine, Montana, New Hampshire, Oregon and Wyoming. California had 54, instead of the 889 from a year earlier, representing a 94 percent drop.

The news is not good for low-income older workers, who are four times as likely to be unemployed as their higher-earning contemporaries, according to a labor economist at the recent Gerontological Society of America's national conference in Boston.

SCSEP is the largest federally funded program for older adults and is the last vestige of the jobs programs that began during the depression-era New Deal under the Works Progress Administration. It s a community service and work training program for older adults. Participants work an average of 20 hours a week and are paid minimum wage. Subsidizing jobs at day-care centers, senior centers, schools and hospitals are intended to help older adults find unsubsidized jobs.

Participants must be over 55, unemployed and with an income of less than 125 percent of the federal poverty level.

Currently the Department of Labor, which oversees the program, reports 46,000 participants in fiscal year 2011, but that is down from the 100,000 participants in year earlier. Of the 46,000, roughly 89 percent were at or below the poverty level.

For these workers the Great Recession has been particularly tough. During 2010, more than 8.3 million people from 55-74 lived in households with incomes of no more than $20,000 a year, representing roughly 15 percent of that cohort, according to Andrew Sum, director of the Center for Labor Market Studies and an economics professor at Boston's Northeastern University.

This low-income older population is far more likely to be female, black or Hispanic, a high school dropout, and unmarried, Sum said.

The current 7 percent unemployment rate for workers over 55 is below the national average, but it is the highest rate since World War II for this group, Sum told the GSA conference.
